GENERAL PROVISIONS
- 1.1. These terms and conditions for the purchase and sale of goods (hereinafter referred to as the "Rules") are a legally binding document for the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the e-shop.
- 1.2. The Seller reserves the right to change, amend, or supplement the Rules at any time, taking into account the requirements established by the laws. The Buyer is informed on the e-shop website. The Rules applicable to the Buyer when shopping in the e-shop are those in effect at the time the order is placed.
- 1.3. The right to purchase in the e-store belongs to:
- 1.3.1. capable natural persons, i.e., persons who have reached the age of majority and whose legal capacity is not restricted by court order;
- 1.3.2. Minors under 18 are prohibited from purchasing goods and visiting our website www.allstarretro.com
- 1.3.3. Legal entities;
- authorized representatives of all the aforementioned persons.
- 1.4. By confirming these rules, the Seller also guarantees that, based on Article 1.3 of these rules, the Buyer has the right to purchase goods in the e-shop.
- 1.5. The agreement between the Buyer and the Seller shall be considered concluded from the moment the Buyer, after creating a shopping cart in the e-shop, specifying the delivery address, choosing a payment method, and familiarizing themselves with the Seller's terms and conditions, clicks the „Confirm Order“ button (see Section 5 „Order of Goods, Prices, Payment Procedure, Terms“).
- 1.6. Each contract concluded between the Buyer and the Seller is stored in the e-shop.
Personal data protection
- 2.1. The Buyer can order goods in the online store:
- by registering in this online store – by entering the data requested in the registration;
- 2.1.2. without registering in this online store.
- 2.2. When ordering goods in the manner specified in clause 2.1., the Buyer, in the respective information fields provided by the Seller, must indicate the Buyer's personal data necessary for the proper execution of the order: name, surname, delivery address of goods, telephone number, e-mail address, date of birth. (The customer is liable for providing a false date of birth in accordance with the law).
- 2.3. By confirming these rules, the Buyer agrees that the Buyer's personal data provided in clause 2.2 will be processed for the sale of goods and services in the e-shop, for Seller's activity analysis and direct marketing purposes.
- 2.4. By agreeing to the processing of the Buyer's personal data for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees that informational messages necessary for the fulfillment of the product order will be sent to the Buyer's specified email address and phone number.
- 2.5. By registering in the e-shop and ordering goods, the Buyer undertakes to protect and not disclose login details to anyone.
Buyer's rights and obligations
- 3.1. The Buyer has the right to purchase goods in the e-shop in accordance with these Terms and other information sections of this e-shop.
- 3.2. The Buyer has the right to withdraw from the purchase and sale agreement with the online store by notifying the Seller in writing (by email, stating the item to be returned and its order number) no later than 14 (fourteen) business days from the date of delivery of the item, except in cases where the agreement cannot be withdrawn from according to the laws of the Republic of Lithuania (e.g., when the agreement is concluded for the sale of hygiene products – bedding; see information on the website of the Public Institution „Consumer Center“ at Vartotojų centras, point 18 of „Peculiarities of Return and Exchange of Non-Food Goods“).
- 3.3. The buyer may use the second option provided in clause 3.2 of the Rules only if the goods have not been damaged or their appearance has not substantially changed, and also if they have not been used.
- 3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
- 3.5. If the data provided in the Buyer's registration form changes, the Buyer must update it immediately.
- 3.6. The Buyer undertakes not to transfer their login details to third parties. If the Buyer loses their login details, they must immediately inform the Seller through the contact methods provided in the „Contacts“ section.
- 3.7. By using the e-shop, the Buyer agrees to these Purchase and Sale Terms and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
Seller's rights and obligations
- 4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store.
- 4.2. If the Buyer attempts to disrupt the stability and security of the Seller's e-shop or violates their obligations, the Seller has the right to immediately and without notice restrict or suspend the Buyer's access to the e-shop or, in exceptional cases, cancel the Buyer's registration.
- The Seller undertakes to respect the Buyer's right to privacy regarding the personal information belonging to the Buyer, specified in the e-shop registration form.
- 4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
Ordering goods, prices, payment procedure, terms
- 5.1. The Buyer can shop in the online store 24 hours a day, 7 days a week.
- 5.2. The Agreement shall enter into force from the moment the Buyer clicks the „Confirm Order“ button, and upon receiving the order, the Seller confirms it by sending a confirmation email to the Buyer's specified email address.
- 5.3. The prices of goods in the online store and in the formed order are indicated in euros, including VAT.
- 5.4. The Buyer undertakes to pay for the goods immediately. Only upon receipt of payment for the goods will the parcel be prepared and the delivery time for the goods will begin to be calculated.
Product Delivery
- 6.1. The Buyer, having chosen the goods delivery service at the time of ordering, undertakes to indicate the exact place of goods delivery.
- 6.2. The Buyer undertakes to accept the goods in person. In the event that the Buyer cannot accept the goods in person, and the goods have been delivered to the specified address, the Buyer shall have no right to lodge claims against the Seller regarding the delivery of the goods to an unauthorized recipient.
- 6.3. Goods are delivered by the Seller or an authorized representative of the Seller (courier).
- 6.4. The Seller shall deliver the goods to the Buyer within the terms indicated in the product descriptions. These terms are preliminary and do not apply if the Seller does not have the necessary goods in stock and the Buyer is informed about the unavailability of the ordered goods. The Buyer also agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such cases, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery.
- 6.5. In all cases, the Seller is released from liability for violation of the delivery terms of the goods if the goods are not delivered to the Buyer or delivered late due to the fault of the Buyer or due to circumstances beyond the Seller's control.
- 6.6. In all cases, the Buyer must immediately inform the Seller if the shipment is presented in a dented or otherwise damaged package, if the shipment contains unordered goods or an incorrect quantity thereof, or if the goods are incomplete.
- 6.7. In all cases, if the Buyer notices package damage during delivery, they must note it in the shipment delivery document provided by the courier or draw up a separate report regarding such damage. The Buyer must do this in the presence of the courier. If these actions are not taken, the Seller shall be released from liability to the Buyer for damages to the goods related to package damage that the Buyer did not note in the courier's delivery document.
Product quality, warranty
- 7.1. The data of each product sold in the online store is generally specified in the product description next to each product.
- 7.2. The Seller is not responsible if the products in the online store do not match the actual size, shape, and color of the products in terms of color, shape, or other parameters due to the characteristics of the display used by the Buyer.
- 7.3. For certain goods, the Seller provides a quality guarantee for a specified period, the specific term and other conditions of which are indicated in the descriptions of such goods.
- 7.4. If the seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
Returns and exchanges
- 8.1. Defects in goods sold shall be rectified, and defective goods shall be exchanged or returned in accordance with the Rules for the Return and Exchange of Goods approved by Order No. 217 of the Minister of Economy of the Republic of Lithuania of June 29, 2001 „On the Approval of the Rules for the Return and Exchange of Goods“, except for cases where the contract cannot be canceled by law (when the contract is concluded for the sale of hygiene products – bedding; see information on the website of the Public Institution „Consumer Center“, point 18 of „Specifics of Returning and Exchanging Non-Food Items“). In all cases, money for returned goods shall only be transferred to the payer's bank account.
- 8.2. To return goods pursuant to clause 8.1 of these Rules, the Buyer may do so within 14 (fourteen) working days from the date of delivery of the goods to the Buyer, by informing the Seller using the contact methods specified in the "Contact Us" section, indicating the name of the item being returned, the order number, and the reason for return.
- 8.3. When the buyer returns goods, the following conditions must be met:
- 8.3.1. The returned item must be in its original, intact packaging;
- 8.3.2. the goods must be undamaged by the Buyer;
- 8.3.3. the product must be unused, must retain its marketable condition (undamaged labels, intact protective film, etc.) (this point does not apply if a defective product is returned);
- 8.3.4. The returned item must be in the same condition as the Buyer received it;
- 8.3.5. When returning an item, the proof of purchase must be provided.
- 8.4. The Seller has the right to refuse to accept returned goods from the Buyer if the Buyer fails to comply with the procedure for returning goods established in Article 8.3.
- 8.5. When returning an incorrect item and/or a defective item, the Seller undertakes to collect such items and replace them with analogous suitable items.
- 8.6. If the Seller does not have suitable goods for replacement, the amount paid by the Buyer will be refunded, excluding the delivery cost.
Buyer and seller responsibility
- 9.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the consequences thereof and acquires the right to claim compensation from the Buyer for direct losses incurred.
- 9.2. The Buyer is responsible for actions performed using this e-shop.
- The registered Buyer is responsible for the transmission of their login credentials to third parties. If a third party uses the e-shop services by logging into the e-shop using the Buyer's login credentials, the Seller shall consider this person as the Buyer.
- 9.4. The Seller is released from any liability in cases where losses arise because the Buyer, disregarding the Seller's recommendations and the Buyer's obligations, did not familiarize themselves with these Rules, even though such an opportunity was provided to them.
- 9.5. If the Seller's e-shop contains links to the websites of other companies, institutions, organizations, or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites, and does not represent those companies and individuals.
- 9.6. In case of damage, the liable Party shall compensate the other Party for direct losses.
Marketing and information
- 10.1. The Seller may, at its sole discretion, initiate various promotions on the e-shop.
- 10.2. The Seller has the right to unilaterally change or cancel the terms of promotions without separate notice. Any change or cancellation of the terms and conditions of promotions shall take effect prospectively, i.e., from the moment they are made.
- 10.3. The Seller shall send all notifications to the contact methods specified in the Buyer's registration form.
- 10.4. The Buyer shall send all notifications and inquiries to the phone numbers and email addresses specified in the „Contacts“ section of the Seller's online store.
- 10.5. The Seller is not responsible if the Buyer does not receive sent informational or confirmation messages due to internet connection or email service provider network disruptions.
Plagiarism of the HotSmoke.lt website
- 11.1 Copying the page content (texts, design, style, functionalities, etc.) is strictly prohibited.
- 11.2 Plagiarism or similarity to the www.allstarretro.com website may result in a fine of 50,000 euros.
Final provisions
- 12.1. These terms and conditions for the purchase and sale of goods are drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
- 12.2. Any disputes arising from the implementation of these Rules shall be settled through negotiation. If an agreement cannot be reached, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
